The United States section below applies to customers in the United States. The European section applies to customers in the European Economic Area and the United Kingdom. If a mandatory local rule gives you a stronger right, that rule applies.
United States
1. Orders
You place an order by completing the form on the site. A phone confirmation from our team is part of the order. The contract is formed when we confirm the order. Prices are shown in euro and are the prices in effect when you submit the form. We may correct an obvious pricing error before confirmation.
2. Payment
Unless a page says otherwise, you pay the courier in cash when the package is delivered. No advance payment is required for cash-on-delivery orders.
3. Delivery and risk
Delivery times on the site are estimates, not guaranteed dates. Risk of loss passes when the courier hands you the package. If we cannot ship within the time we stated, we will contact you and you may cancel before shipment.
4. Limited warranty
Products are covered by a limited warranty against manufacturing defects for 24 months from delivery. The warranty does not cover misuse, accidents, or normal wear. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
5. Liability
To the extent allowed by US law, our liability for a product is limited to the amount you paid for that order. We are not liable for indirect or consequential damages, except where a state law does not allow that limit, including for personal injury caused by a product defect.
6. Disputes
For customers in the United States, these terms are governed by the laws of the State of Delaware, excluding conflict-of-law rules. Courts in Sussex County, Delaware may hear a dispute, without limiting any non-waivable right you have in your home state.
European Union, EEA, and United Kingdom
1. Seller and contract
The Seller is County of Sussex. Submitting an order and confirming it by phone means you accept these terms. Mandatory consumer protections in your country of residence still apply and cannot be reduced by these terms.
2. Price and payment
Prices include VAT where VAT is due. Payment is in cash to the courier on delivery, unless the product page states another method. You owe nothing if you refuse a cash-on-delivery parcel at the door.
3. Withdrawal
Under Directive 2011/83/EU and the matching UK rules, a consumer may withdraw within 14 days of receiving the goods, without giving a reason. We extend that period to 30 days. Tell us by email at info@instantgadgetshop.com. You then have 14 days to send the goods back. We refund the price within 14 days of receiving the return, or of proof that you sent it. 4. Conformity
Goods must match the description and be fit for ordinary use. The legal guarantee of conformity lasts at least 24 months from delivery. A defect that appears in the first year is presumed to have existed at delivery, unless we show otherwise, where that presumption applies in your country.
5. Liability and law
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot legally be limited. For consumers, the mandatory law of your country of residence applies to the contract, and you may sue in the courts of that country. You may also use the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
